General Conditions

1. OBJECT
1.1
These General Contractual Conditions are intended to establish the terms and conditions governing the provision of travel services organized by 1970 TRAVEL, LDA., A company established at Av. Dr. Antunes Guimarães, 166, 4100-073 Porto , registered at the Commercial Registry Office of Vila Nova de Gaia, with the unique registration number and legal person 500 988986, with the registered capital of one hundred thousand euros, with Registration No. 1798, in the National Register of Travel Agencies and Tourism (RNAVT) (hereinafter referred to as AGENCY), in addition to any Special Conditions agreed upon between the Client and the AGENCY.
1.2. The terms contained in the Special Conditions, if any, shall prevail over the provisions of these General Conditions and shall prevail over both written additional stipulations especially agreed between the Client and the AGENCY.
1.3. Services and products are offered to you under the terms and conditions set forth herein.
1.4 The information contained in the program is binding on the AGENCY unless cumulatively:

  • The Program expressly provides for it;
  • The changes to it are insignificant;
  • The change information is provided to the traveler on a lasting basis.

1.5 By contracting with the AGENCY, the Customer acknowledges and accepts all the terms and conditions established and declares that he / she has expressly acknowledged them.
1.6 These general conditions comply with the provisions of Decree-Law 17/2018 of 08 March.
1.7 The General Conditions which are the subject of an Organized Trip or Related Travel Service contained in this program, the corresponding standardized information sheets and the particular conditions contained in the travel documentation provided to the Traveler at the time of booking of the travel materialize the travel contract. linking the parties.

 

2. REGISTRATIONS
2.1
Upon registration and reservation the customer must pay 100% of the total service to be contracted.
2.2 If the trip to which the customer subscribes is the result of a combined tour operator program that is not the result of automatic booking processes, a payment of 25% of the travel price shall be made, the remaining 75% being paid within 21 days. before the trip starts.
2.3 It should be noted that suppliers impose different payment terms than those above, regardless of the advance booking, the conditions of these suppliers prevailing as particular conditions. If applicable, the AGENCY will communicate the amount payable as soon as it obtains this information and it is the client's responsibility to ensure the respective payment to make the reservation.
2.4 The AGENCY reserves the right to cancel any registration for which payment has not been made under the above conditions.
2.5 Reservations are conditional upon suppliers obtaining confirmation of all services.

 

3. SPECIAL CONDITIONS FOR CHILDREN
Given the diversity of conditions applied to children (destination and supplier) it is always advisable to question the special conditions that may apply to the trip in question.

4. BULK SERVICE RESERVATIONS
4.1 Flight Booking
4.1.1
The AGENCY makes flight reservations using a global reservation system and is responsible for such reservations in accordance with the law.
4.1.2 The responsibility for reporting availability, times, equipment type, stopovers and airports is entirely the responsibility of the airlines.
4.1.3 The customer must, prior to departure, reconfirm with the airline or the AGENCY services the time (s) of the flight (s) to be used. The AGENCY is not responsible for time changes made by the airlines.
4.1.4 Departure and arrival times are given in your country's local time and in accordance with the schedules of the respective airlines,
4.1.5 Prices quoted may not include additional services such as meals on board, luggage, check-in, etc. The customer should, if they do not obtain information when booking, contact the AGENCY.
4.1.6 In order to reduce the cost of travel to the customer, the AGENCY may offer travel solutions that result from issuing multiple tickets.
4.1.7 Some airlines operate equipment sharing systems for certain destinations (codeShare) and the flight may be operated by another carrier.
4.1.8 The rates used are normally restrictive and non-refundable, and this information is made available prior to booking.
4.1.9 The issuance of transport tickets establishes the contract with the transport companies and the passengers are subject to the specific transport conditions, which are stated in the respective transport ticket issued.
4.2 ACCOMMODATION RESERVATION
4.2.1
The AGENCY makes hotel reservations using reservation centers and / or own hiring or directly with hotel units at the destination.
4.2.2 Responsibility for the availability and pricing information of the desired accommodation rests with the suppliers.
4.2.3 The proposed rates are dynamic and, if the reservation is not made immediately, may change prices.
4.2.4 The available accommodation typologies are presented by the service providers. Any special requests will be sent to the service provider but cannot be handled by the AGENCY.
4.2.5 The AGENCY, after booking, payment and good collection of the selected stay, will issue a voucher that will be delivered or sent by email to the client which must be presented upon check-in.
4.2.6 Confirmation of a booking through the AGENCY is communicated to the supplier in accordance with the conditions established in the contract and may not be immediate in certain cases, in particular when the booking is not for the same day.
4.2.7 Hotel units provide a description of their facilities and services and are solely responsible for the information provided.
4.2.8 The group, classification and denomination of the accommodation are determined by the host state which are sometimes different from those used in Portugal. The list of hotels and apartments presented is indicative as well as their category. As regards accommodation, the following particular rules apply:
i) Apartments: It is the Client's full and complete responsibility to inform the number of people (adults and children) who will occupy the apartment. In case of more people than the ones booked, those responsible for the accommodation may refuse entry or directly charge any differences between the amount paid at the AGENCY and the cost of re-typification of the apartment.
ii) Hotels: Prices quoted are per person and based on double room occupancy. Not all hotels have a triple room, so an extra bed is placed in a double room, which may not be of identical quality and comfort. In the case of rooms similar to twin or double beds, it is considered that, in most cases, triple is made up of only these two beds.
4.2.9 Timetable: As an indicative rule, rooms can normally be used from 2pm on the day of arrival and should be left free before 12pm on the day of departure. In apartments, the entrance is usually at 17h on the day of arrival, and they must be free before 10h on the day of departure. Key collection is normally made within normal office hours, at the reception desk or at a location designated by the Agency.
4.2.10 Half-board and full-board stays do not include meals that coincide with flight times, transportation to and from the airport, and waiting for air connections.
On arrival at the hotel after 7 pm the first meal service will be breakfast the next day. On the last day and unless late check-out is possible, the hotel's last service will be breakfast.
4.2.11 Unless otherwise specified, beverages are not included in full and / or half board.
4.2.12 Any specific meal order from the Customer is always subject to confirmation from the supplier and may require payment of a supplement.
4.3 CAR RENTALS
4.3.1
The AGENCY acts as a mere intermediary in car rental services by directing rental requests to suppliers of this type of service. in destiny.
4.3.2 The price information, type of car, place of delivery and other information regarding car rental is the responsibility of the selected supplier. Suppliers distribute their fleet by groups, and the make and model of vehicles associated with a particular group is purely indicative and only the reserved group is guaranteed in the reservation.
4.3.3 The customer accepting the reservation is subject to the conditions of service provision of the hired rental company.
4.3.4 The AGENCY is not responsible for any breach by the supplier.
4.3.5 The customer is responsible for the payment of any extras contracted locally and not considered in the price initially informed.
4.4 OTHER SERVICES
4.4.1
Service requests are processed and answered by email, whenever possible, to customers with the submission or delivery of a proposal.
4.4.2 The services requested with payment (even partial) are subject to availability by the respective suppliers and cannot be considered reserved, so the values ​​may change until the confirmation by the service provider.
4.4.3 The award of the proposal by the client must be in writing and implies the payment of the registration fee under the terms of 2.

 

5 INFORMATION UNDER LAW No. 144/2015 OF SEPTEMBER 8
Pursuant to Law No. 144/2015 of September 8, we inform that the Client may resort to the following Alternative Dispute Resolution Entities:
i) Client Provider of Travel and Tourism Agencies in www.provedorapavt.com;
ii) Arbitral Commission of Tourism of Portugal in www.turismodeportugal.pt

6 COMPLAINTS
Any non-compliance with the performance of a travel service included in the package travel contract must be reported to the organizing or retail travel agency in writing or otherwise as soon as such non-compliance occurs, ie without undue delay.
6.1 The right to lodge claims for the purpose of price reductions or the right to compensation for non-compliance of travel services included in package travel shall lapse within 2 years.
6.2 In the event of a claim for non-compliance with the contracted services, the customer may initiate the Travel and Tourism Guarantee Fund and shall submit his claim to the following entities and within the following deadlines:
i) From the Customer Provider as RASO, Viagens e Turismo, S.A is a member of the Customer Provider of Travel and Tourism Agencies in www.provedorapavt.com. To use this service you must submit your complaint in writing within 20 business days after the end of the services. The agencies are bound by the timely compliance with the decision that may be issued by such entity.
ii) At Turismo de Portugal I.P in www.turismodeportugal.pt within 60 days after: (i) the end of the trip; (ii) the cancellation of the trip attributable to the agency; (iii) the date of knowledge of the impossibility of its realization due to the fact attributable to the agency; (iv) the closure of the establishment.

 

7 BAGGAGE:
7.1
The AGENCY is responsible for the luggage under the legal terms;
7.2 The customer has an obligation to complain to the service provider at the time of baggage removal, deterioration or destruction.
7.3 In international transport, in case of damage to the baggage, the claim must be made in writing to the carrier immediately after the damage has been verified, and within 7 days of delivery. In case of mere delay in the delivery of luggage, the claim must be made within 21 days from the date of delivery.
7.4 The filing of such a claim is provided for in the International Conventions and is essential for triggering the AGENCY's responsibility over the entity providing the service.

 

8 LIMITS
8.1
The liability of the AGENCY shall be limited to the maximum amount payable to entities providing services under the Montreal Convention of 28 May 1999 on International Air Transport and the Berne Convention of 1961 on Rail Transport.
8.2 With regard to maritime transport, travel agents' liability towards their customers for the provision of transport services or accommodation, where appropriate, by maritime transport companies in the event of damage resulting from intent or negligence. The following amounts shall be limited to:
a) € 441,436 in the event of death or personal injury;
b) € 7,881, in case of total or partial loss of luggage or damage to it;
c) € 31,424 in case of loss of motor vehicle, including the luggage contained therein;
d) € 10,375, in case of loss of luggage, whether or not accompanied by a motor vehicle;
e) € 1,097 for damage to luggage as a result of damage to the motor vehicle.
(f) Where applicable, the liability of travel and tourism agencies for the deterioration, destruction and subtraction of luggage or other items in tourist accommodation establishments while the customer is staying there shall be limited to:
g) € 1,397, globally;
h) € 449 per article;
(i) the value declared by the customer for the articles deposited in the custody of the tourist accommodation establishment.
j) The agency's liability for non-bodily harm may be contractually limited to three times the price of the service sold.

 

9. RESERVATION AND CHANGE RATES AND EXPENSES
9.1
Each service booked through the AGENCY is subject to a service charge that is posted in stores in a visible location and will be confirmed prior to the booking request being made.
9.2 The customer, when booking, accepts the rates mentioned therein.
9.3 For flights, airport charges are broken down and differentiated from the cost of airfare.
9.4 In some destinations, there are airport, entrance, departure, local, and other charges that must be paid locally, but will be indicated prior to booking
9.5 Some cities charge a tourist tax. Normally the value is not included in the price of the accommodation and must be paid locally.
9.6. Change Expenses: For each change (names, dates, room or room type, travel, etc.): € 35. Please note that acceptance of such changes is subject to acceptance by their suppliers.

 

10 DOCUMENTATION
10.1
The client must have in good order his / her personal or family documentation (identity card, military documentation, authorization for minors, visas, certificate of vaccines and others if required). The AGENCY declines any responsibility for refusing to grant visas or not allowing the client to enter a foreign country; The client is also responsible for any and all costs that such situation entails.
10.2 Travel in the European Union:

  • Customers (regardless of age) traveling within the European Union must be in possession of their civil identification (passport; B.I, Citizen's Card);
  • To obtain medical assistance they must have their European Health Insurance Card;
  • Nationals of non-EU countries should consult specific information regarding the documentation required for travel to embassies / consulates of the countries of origin;

10.3 Travel outside the European Union:

  • Customers (regardless of age) traveling must be in possession of their civil identification (passport) and visa if required (obtain this from the AGENCY at the time of booking)
  • Nationals of non-EU countries should consult specific information regarding the documentation required for travel to embassies / consulates of the countries of origin;

10.4 Minors traveling with or authorized by their parents with other adults are required to have their own identification card; citizen card or ID card, passport. When traveling with a passport, they must also have a citizen card.
10.5 Some countries requiring a passport are required to have a passport longer than 6 months after the date of departure from the country of destination.

 

11 CUSTOMER CHANGES
11.1
If the suppliers of the trip concerned allow, whenever a customer, registered for a particular trip, wishes to change his or her registration for another trip or departing on a different date or any other change, he / she shall pay the fee, as amending expenses (9.6).
11.2 However, when the change takes place 21 days or less prior to the departure date of the trip to which the customer is registered, or if the service providers do not accept the change, they will be subject to the costs and charges. “waiver (termination)”.
11.3 After commencing the trip, if requested to change the services contracted for reasons not attributable to the AGENCY (eg extension of nights stay, change of flight) the prices of tourist services may not correspond to those published in the brochure or proposal that motivated the hiring. .

 

12 REGISTRATION TERMINATION (CONTRACTUAL POSITION)
12.1
The client may assign his / her application, being replaced by another person who fulfills all the conditions required for the trip, provided that he / she informs the agency at least seven days in advance.
12.2 The assignor and the assignee are jointly and severally liable for the payment of the outstanding balance and the fees, charges or additional costs arising from the assignment, which shall be duly informed and substantiated by the AGENCY.

13 CHANGES TO BE MADE BY THE AGENCY
Whenever before the start of the package trip;

  • The AGENCY is obliged to significantly alter some of the key features of travel services;
  • Or fails to meet the special requirements requested by the Traveler;
  • Or propose raising the price of package travel by more than 8%,

The traveler may, within 4 days (period which may change depending on the start date of the trip and / or by imposition by the service provider (s) being the customer informed accordingly when this happens):
(a) accept the proposed amendment;
b) Terminate the contract, without penalty, being reimbursed of the amounts paid;
c) Accept a replacement travel package proposed by the travel agency and will be refunded in case of price difference.
13.2. Failure by the traveler to reply within the time limit set by the agency will imply tacit acceptance of the proposed amendment.

 

14 CANCELLATIONS BY THE AGENCY
14.1
Where travel is dependent on a minimum number of participants, the Agency reserves the right to cancel the package if the number of participants reached is less than the minimum. In such cases the customer will be informed in writing of the cancellation within
(a) 20 days prior to the commencement of the package, in the case of travel longer than six days;
(b) 7 days prior to the commencement of the package voyage for journeys lasting two to six days;
(c) 48 hours prior to the commencement of the package journey for journeys of less than two days duration.
14.2. Prior to the commencement of the package travel, the AGENCY may also terminate the contract if it is prevented from performing the contract due to unavoidable and exceptional circumstances.
14.3. Termination of the travel agreement by the AGENCY under the above terms only entitles the traveler to the full refund of payments made within 14 days of termination of the travel agreement.

 

15 CHANGE IN PRICE (package travel)
15.1
Constant prices are based on service costs and exchange rates prevailing at the time of publication and are subject to change resulting from changes in transportation or fuel costs, duties, taxes, charges and exchange rate fluctuations up to 20 days. before the travel date.
15.2 If the increase in question exceeds 8% of the total price of the package, the provisions of clause 13 - “AMENDMENTS TO BE MADE BY THE AGENCY” shall apply.
15.3. In the event of a price reduction, the Agency reserves the right to deduct from the reimbursement to the traveler the corresponding administrative expenses, which at the traveler's request will be justified.

 

16 REFUNDS
Once the service is started, no refund is due for services not used by the customer for reasons of force majeure or attributable to the customer, unless refunded by their suppliers. Failure to provide services provided for reasons attributable to the organizing agency and if it is not possible to replace them with other equivalents, entitles the customer to be reimbursed for the difference between the price of the services provided and those actually provided.

 

17 TERMINATION (TERMINATION)
17.1
. The Client or one of his companions is free to give up the trip at all times.
17.2 Such termination implies that it will be responsible for paying all charges for which the commencement of performance of the contract and its withdrawal give rise to less reallocation of services and cost savings.
17.3 Where applicable, the customer will be reimbursed for the difference between the amount paid and the above amounts. In this situation the refund will be made, less the termination fee, within 14 days after the termination of the travel contract.
17.4 The traveler is also entitled to terminate the travel contract prior to commencement of the travel without paying any termination fee if there are unavoidable and exceptional circumstances at or near the place of destination that considerably affect its performance or transportation. of passengers to the destination. Termination of the travel contract in this situation only entitles the traveler to the full refund of payments made.

18 LIABILITY
18.1
The travel and tourism agency is responsible for the correct execution of all travel services included in the travel contract.
18.2. In the case of package travel, the AGENCY is responsible to Travelers, even if the services must be performed by third parties and without prejudice to the right of return, in accordance with the applicable general terms.
18.3. Organizing travel and tourism agencies respond jointly with retail agencies in the case of package travel
18.4. In the other travel services, the AGENCY is responsible for the correct issuance of accommodation and transport permits and also for the wrong choice of service providers, if they have not been suggested by the traveler.
18.5. The AGENCY acting as intermediary in the sale or booking of single travel services is liable for errors in the issuance of their securities, even in cases of technical deficiencies in the booking systems attributable to them.
18.6. The AGENCY is liable for any errors due to technical deficiencies in the booking system attributable to it and, if it has agreed to book an organized trip or travel services that are part of related travel services, for errors made during booking process.
18.7. The AGENCY is not responsible for booking errors that are attributable to the traveler or caused by unavoidable and exceptional circumstances.

 

19. ASSISTANCE
19.1
. In the event of a traveler's difficulties, or when for reasons not attributable to him, he cannot finish the package, the AGENCY will provide the following assistance:
(a) providing adequate information on health services, local authorities and consular assistance;
b) Assistance to travelers in conducting distance communications and finding alternative travel solutions.
19.2 If the difficulty underlying the request for assistance was caused by the traveler deliberately or through negligence, the AGENCY may charge a fee in the amount of the costs incurred as a result of providing such assistance.
19.3 If, due to unavoidable and exceptional circumstances, the traveler cannot return, the organizing agency shall be responsible for ensuring the necessary accommodation costs, if possible of equivalent category, for a period not exceeding three nights per traveler. The retail AGENCY shall be jointly and severally liable for the obligation in question, without prejudice to the right of recourse, as applicable.
19.4 The above limitation of costs does not apply to persons with reduced mobility, their accompanying persons, pregnant and unaccompanied children, or persons in need of specific medical care, provided that the travel agency has been notified. these specific needs at least 48 hours before the start of the package trip.

 

20 INSOLVENCE
In the event of insolvency of the travel and tourism agency, the traveler may resort to the Travel and Tourism Guarantee Fund, and to this end should resort to Turismo de Portugal I.P entity responsible for its activation: Turismo de Portugal, I.P.

21 INSURANCE
21.1
Under the terms of the legislation in force, the agency's liability is guaranteed by a liability insurance in the company Seguradora Fidelidade Mundial with policy n ° 0035816 in the amount of € 99 760,00.
21.2 The agency also offers the sale of insurance that can be purchased depending on the trip to guarantee assistance situations and cancellation expenses.


22 PAYMENT METHODS
22.1
The AGENCY provides the following payment methods:

  • MB Reference
  • Credit card
  • Money
  • Bank transfer*

* The use of payments by bank transfer is only possible in some services / products and the customer, if you want to use this form of payment, contact the AGENCY by email or by phone.
22.2 Payment methods are indicated according to the type of service booked and may in some situations not allow the use of the payment methods indicated in 23.1.
22.3 Payment for services using pre-purchased products such as Travelers Checks and others is not automatically possible and requires the submission of original documents.
22.4 Travel documents are issued upon payment and verification of good collection. The Agency reserves the right to cancel bookings that have not been paid within the indicated deadlines or if fraud is suspected.
22.5 In case of suspicion of fraud with the use of credit cards for payment, the AGENCY may request the delivery of a copy of the used card and a copy of identification document.
22.6. In the event of a fraud, services are automatically canceled regardless of whether travel documents are issued or until travel and / or stay has commenced.

 

23. LEGISLATION AND JURISDICTION
All disputes arising from the interpretation or execution of these General Conditions shall apply under Portuguese law.

 

24. CHANGES TO GENERAL CONDITIONS
The Agency reserves the right to amend these Terms and Conditions at any time and whenever deemed necessary, informing the client and prior to making the reservation. Such change will not, however, affect reservations already made.

 

25. FAULTS
If any part or provision of these General Conditions is found to be void or of no effect, the remaining provisions will remain in effect and their overall validity will not be affected unless it can be concluded that the parties would not have agreed to provide service or supply of the product if they had provided for the invalidity or ineffectiveness of the provision in question.

 

Notes:

  • The remaining special conditions will be included in the leaflet of each specific destination and trip - particular conditions - and which are part of the travel contract.
  • These general conditions may be complemented by any other specific conditions as long as agreed by the parties.
  • The prices of the programs are based on the average dollar exchange rate and any relevant derivation of this currency may entail a review of travel prices under the “price change” clause.
  • Due to the constant changes in the price of fuels over the prices charged there may be a change in the fuel supplement inserted in the price under the terms of the “price change” clause.
  • The categories of hotels and cruises shown in the brochures follow the quality standards of the host country and may be changed by similar ones when for reasons other than the agency it is not possible to maintain or confirm the existing reservation and the agency is obliged to inform the customer as soon as he becomes aware of it.

    
General information
Arrival or Departure Times

Departure and arrival times are indicated in the respective local time of your country and in accordance with the schedules of the respective airlines at the time of printing of this program and may therefore be subject to change.
For trips that include bus transportation the times indicated are approximate.

 

Meals
Unless otherwise stated, drinks are not included in the lunch or dinner provided for in their travel programs (full and / or half board). Any specific meal order from the Customer is always dependent on the supplier's confirmation and may require payment of a supplement.
Half-board and full-board package tours do not include meals that coincide with flight times, transfers to and from the airport and waiting for air connections.

Arrival and departure times
